Cancellation & Refund Policy

This Cancellation & Refund Policy ("Cancellation Policy") applies to all safari bookings made with Legacy Conservation Safaris (Pty) Ltd ("Legacy Conservation Safaris", "the Company", "we", "our" or "us"). This Cancellation Policy forms part of the Legacy Conservation Safaris Terms & Conditions and must be read together with those Terms & Conditions and the applicable Liability Waiver, Assumption of Risks & Release. Nothing in this Cancellation Policy is intended to exclude, restrict or limit any right or protection that cannot lawfully be excluded, restricted or limited under applicable law.

1. Cancellation by the Client

1.1 All cancellations must be submitted in writing to info@legacysafaris.org.

1.2 A cancellation will take effect on the date that Legacy Conservation Safaris receives the written cancellation.

1.3 The applicable cancellation terms are determined by the date on which the cancellation is received in relation to the scheduled Departure Date, subject to the 14-day cancellation provision in Section 2.

1.4 For purposes of this Cancellation Policy, the Departure Date means the scheduled first day of the Safari stated in the Client's Booking Confirmation.

2. Cancellation Within 14 Days of Booking

If you cancel your Booking within 14 days of the date your Booking was confirmed, and the cancellation is made more than 100 days before departure, you will receive a 100% refund of your deposit. If you cancel within 14 days of the date your Booking was confirmed but the cancellation is made 100 days or less before departure, the cancellation terms applicable to the relevant period in Sections 4 or 5 will apply.

3. Cancellation More Than 100 Days Before Departure

If you cancel your Booking more than 100 days before departure, and the cancellation does not qualify for the refund described in Section 2:

  • your deposit is non-refundable
  • up to 75% of your deposit may, at the discretion of Legacy Conservation Safaris, be transferred to another Legacy Conservation Safaris trip or retained as a credit for future travel
  • any portion of the deposit that is not transferred or retained as a credit remains non-refundable

Any transfer or credit is subject to availability, the applicable booking terms and any difference in price between the original Booking and the new Safari.

4. Cancellation Between 100 and 60 Days Before Departure

Full payment is due 100 days before departure. If you cancel your Booking between 100 and 60 days before departure:

  • all payments made are non-refundable and non-transferable
  • Legacy Conservation Safaris may, at its discretion, provide a refund of up to 25% of the total trip cost

If the Client cancels the Booking after the final payment due date, the Client remains responsible for any outstanding balance that is payable under this Cancellation Policy. Cancellation of the Booking does not, by itself, cancel an amount that has already become due and payable. Any refund offered under this section is discretionary and is not guaranteed, subject to any rights the Client may have under applicable law.

5. Cancellation Less Than 60 Days Before Departure

If you cancel your Booking less than 60 days before departure, all amounts paid are 100% non-refundable and non-transferable. If the Client cancels the Booking after the final payment due date, the Client remains responsible for any outstanding balance that is payable under this Cancellation Policy. Cancellation of the Booking does not, by itself, cancel an amount that has already become due and payable. No refund, credit or transfer will be provided, subject to any rights the Client may have under applicable law.

6. Cancellation by Legacy Conservation Safaris Due to Minimum Occupancy

Legacy Conservation Safaris requires a minimum of five (5) confirmed paying guests per departure. A departure with fewer than five (5) confirmed paying guests will not ordinarily operate and may be cancelled or otherwise amended by the Company. Where the minimum occupancy has not been reached, Legacy Conservation Safaris may:

  • offer the Client an alternative departure date
  • offer an alternative Safari or itinerary
  • offer the Client the option to proceed subject to an agreed additional cost
  • cancel the departure and provide an appropriate refund or alternative arrangement

Legacy Conservation Safaris will make reasonable efforts to notify affected Clients as soon as reasonably practicable. Where Legacy Conservation Safaris cancels a departure because the minimum occupancy has not been reached, this will not be treated as a cancellation by the Client, and the cancellation charges in Sections 2 to 5 will not apply. Where an alternative departure or arrangement is offered and accepted by the Client, the terms of that alternative arrangement will apply.

7. Cancellation or Changes Due to Circumstances Beyond the Company's Reasonable Control

Legacy Conservation Safaris may cancel, postpone or substantially amend a Safari where circumstances beyond the Company's reasonable control make it impossible, unsafe or impractical to operate the Safari as planned. Such circumstances may include, but are not limited to:

  • natural disasters
  • floods
  • wildfires
  • severe weather
  • disease outbreaks or pandemics
  • government restrictions
  • border closures
  • political unrest
  • civil disturbance
  • terrorism or security incidents
  • strikes or industrial disputes
  • airline or other transport disruptions
  • road closures
  • reserve or park closures
  • wildlife-related safety restrictions
  • conservation emergencies
  • other circumstances beyond the Company's reasonable control

Where reasonably possible, Legacy Conservation Safaris may offer an alternative departure date, amended itinerary, alternative accommodation, travel credit or other reasonable alternative. Where Legacy Conservation Safaris is unable to provide the Safari as originally booked, any refund or alternative arrangement will take into account amounts already paid to or committed to Suppliers, amounts recoverable from Suppliers, non-recoverable costs and any rights or obligations arising under applicable law.

8. Illness, Injury or Personal Circumstances

Illness, injury, pregnancy, changes in personal circumstances, inability to travel, visa issues or other personal circumstances do not automatically entitle the Client to a refund outside the cancellation terms set out in this Cancellation Policy. Clients are strongly advised to obtain comprehensive travel insurance covering trip cancellation and interruption, medical expenses and emergency evacuation. Where a cancellation is covered by the Client's travel insurance, the Client should submit a claim directly to their insurer. Legacy Conservation Safaris may consider a request for an alternative arrangement, transfer or credit in appropriate circumstances, but any such arrangement is at the Company's discretion unless otherwise required by applicable law.

9. No-shows, Late Arrivals and Early Departures

No refund will ordinarily be provided where a Client:

  • fails to arrive for the Safari
  • arrives after the scheduled departure
  • misses a transfer or activity
  • voluntarily leaves the Safari early
  • chooses not to participate in an included activity
  • chooses not to use included accommodation
  • otherwise chooses not to use part of the Safari

Any additional costs arising from a Client's late arrival, missed transfer or early departure are the Client's responsibility.

10. Flight Cancellations and Travel Disruption

Legacy Conservation Safaris is not responsible for losses arising from:

  • cancelled flights
  • delayed flights
  • missed connections
  • lost baggage
  • airline strikes
  • airline schedule changes
  • other airline or transport disruptions, Where reasonably possible, Legacy Conservation Safaris will assist the Client with alternative arrangements

Any additional accommodation, transportation, meals or other expenses arising from such disruption are the Client's responsibility unless otherwise agreed or covered by the Client's travel insurance.

11. Transfers and Future Travel Credits

Where Legacy Conservation Safaris agrees to transfer a Booking or provide a future travel credit:

11.1 The transfer or credit is subject to availability.

11.2 Any difference between the price of the original Safari and the price applicable to the new Safari or departure date will be payable by the Client.

11.3 A travel credit is non-refundable and cannot be exchanged for cash unless otherwise agreed by Legacy Conservation Safaris or required by applicable law.

11.4 A travel credit may not be transferred to another person unless expressly approved by Legacy Conservation Safaris in writing.

11.5 Any expiry date or other conditions applicable to a travel credit will be communicated to the Client when the credit is issued.

12. Group Bookings

Where multiple guests are booked together under a single Booking, a cancellation by one or more members of the group may affect the remaining members of the group. If a reduction in group size results in the Booking falling below the minimum occupancy requirement or otherwise affects accommodation, transportation or Supplier arrangements, Legacy Conservation Safaris may amend the Booking or apply any additional costs reasonably arising from the change. Cancellation charges will apply to the individual places cancelled in accordance with this Cancellation Policy.

13. Refunds

Where a refund is approved or otherwise due:

13.1 Refunds will ordinarily be made to the original payment method used for the Booking, unless otherwise agreed.

13.2 Any bank charges, payment-processing fees, foreign-exchange losses or other third-party charges reasonably incurred in connection with the Booking or refund may be deducted from the refund where permitted by applicable law.

13.3 The time required for a refund to reach the Client's account may depend on the relevant bank or payment provider.

13.4 Legacy Conservation Safaris will not be responsible for delays caused by the Client's bank, payment provider or another third party.

14. Cancellation Summary

Important: Where the final payment has become due before cancellation, the Client remains responsible for any outstanding balance that is payable under this Cancellation Policy, subject to applicable law.

15. Travel Insurance

Travel insurance is strongly recommended for all Clients. Clients should obtain insurance that provides adequate cover for:

  • cancellation
  • trip interruption
  • medical expenses
  • emergency evacuation
  • repatriation
  • travel delays
  • baggage and personal belongings
  • other circumstances that may result in financial loss

The Legacy Conservation Safaris Cancellation & Refund Policy does not replace travel insurance.

16. Applicable Law

This Cancellation Policy is governed by the laws of the Republic of South Africa. Nothing in this Cancellation Policy excludes, restricts or limits any right or remedy available to a Client under applicable law. Where any provision of this Cancellation Policy is found to be invalid or unenforceable, that provision will be applied to the maximum extent permitted by law, and the remaining provisions will continue to apply.

17. Acceptance

By paying a deposit, making a payment towards a Safari, signing a Booking Confirmation or otherwise confirming a Booking, the Client acknowledges that they have read, understood and accepted this Cancellation & Refund Policy together with the Legacy Conservation Safaris Terms & Conditions.
