Terms & Conditions

These Terms & Conditions govern all safari bookings made with Legacy Conservation Safaris (Pty) Ltd ("Legacy Conservation Safaris", "the Company", "we", "us" or "our"). By making a booking, paying a deposit, or otherwise confirming a safari with us, the Client ("you", "your" or "Client") agrees to these Terms & Conditions, together with the applicable Cancellation Policy and Liability Waiver, Assumption of Risks & Release. Nothing in these Terms & Conditions is intended to exclude or limit any right or protection that cannot lawfully be excluded or limited under applicable law.
1. About Legacy Conservation Safaris
Legacy Conservation Safaris (Pty) Ltd is a South African safari and conservation-focused tourism company providing guided safari experiences, accommodation, transportation, conservation activities and related travel services. Company: Legacy Conservation Safaris (Pty) Ltd Registration Number: 2026 / 119445 / 07 Email: info@legacysafaris.org Website: legacysafaris.org Country of Registration: Republic of South Africa Legacy Conservation Safaris is responsible for coordinating and delivering the safari services described in the Client's Booking Confirmation and itinerary, subject to these Terms & Conditions.
2. Definitions
For purposes of these Terms & Conditions: "Booking" means a confirmed reservation for a Safari or related travel service. "Client" means the person making the Booking and each person travelling under that Booking. "Departure Date" means the scheduled first day of the Safari as stated in the Booking Confirmation. "Safari" means the safari itinerary and associated services purchased from the Company. "Supplier" means an independent third-party provider engaged to provide accommodation, transport, activities, meals, guiding, park access or other services. "Booking Confirmation" means the written confirmation issued by the Company confirming the Client's Safari and applicable price.
3. Booking & Contract Formation
3.1 A Booking request does not constitute a confirmed reservation until the Company has: 1. accepted the Booking; and 2. received the required deposit or other agreed payment.
3.2 Once the required deposit has been received and the Booking has been confirmed, these Terms & Conditions form part of the agreement between the Company and the Client.
3.3 The person making the Booking confirms that they have authority to make the Booking on behalf of all persons travelling under it and that all members of the travelling party will comply with these Terms & Conditions.
3.4 The Client is responsible for providing accurate information required to arrange the Safari, including names, passport information, flight details, dietary requirements, emergency contact details and other relevant information.
3.5 The Company may decline a Booking where it is unable to reasonably accommodate the requested dates, group size, age of travellers, medical or mobility requirements, or other operational requirements.
4. Minimum Departure Occupancy
4.1 Legacy Conservation Safaris operates small-group Safaris and requires a minimum of five (5) confirmed paying guests per departure for a Safari to operate.
4.2 A departure with fewer than five (5) confirmed paying guests will not ordinarily operate and may be cancelled or otherwise amended by the Company.
4.3 Where the minimum occupancy has not been reached, the Company may, at its discretion:
- offer the Client an alternative departure date
- offer an alternative Safari or itinerary
- offer the Client the option to proceed subject to an agreed additional cost
- cancel the departure and provide a refund or alternative arrangement in accordance with the applicable Cancellation Policy and applicable law
4.4 The Company will make reasonable efforts to notify affected Clients as soon as reasonably practicable if a departure is at risk of not reaching the minimum occupancy.
4.5 The minimum occupancy requirement applies to the number of confirmed paying guests travelling on the departure. Complimentary guests, guides, staff or other non-paying persons do not ordinarily count towards the minimum occupancy requirement.
4.6 The Company will not be required to operate a departure with fewer than five (5) confirmed paying guests unless it expressly agrees to do so in writing.
5. Safari Pricing & Currency
5.1 Unless otherwise stated in writing, all Safari prices are quoted in United States Dollars (USD).
5.2 The price applicable to a Booking is the price stated in the Booking Confirmation.
5.3 Prior to confirmation, the Company reserves the right to amend advertised or quoted prices due to changes in:
- exchange rates
- government taxes
- park or reserve fees
- conservation levies
- fuel costs or surcharges
- accommodation costs
- Supplier pricing
- other mandatory charges outside the Company's reasonable control
5.4 Once a Booking has been confirmed and the required deposit has been received, the agreed Safari price will not be increased except where additional government-imposed taxes, compulsory park or conservation fees, or other mandatory charges are introduced or increased after confirmation.
5.5 Any bank charges, foreign-exchange charges, card-processing charges or other fees imposed by the Client's bank or payment provider are the Client's responsibility unless otherwise agreed in writing.
6. Payment Terms
6.1 Deposit A deposit of 50% of the total Safari price is required to secure a Booking unless otherwise agreed in writing.
6.2 Balance of Payment The remaining balance is due 100 days before the Departure Date.
6.3 Late or Non-Payment If final payment is not received by the due date, your deposit may be forfeited and the Company reserves the right to cancel your Booking, subject to the Company's Cancellation Policy and applicable law.
6.4 The Company may provide written notice requesting payment before cancelling a Booking for non-payment.
6.5 Payment Methods Payment may be made by:
- bank transfer
- credit or debit card
- online payment facility
- another payment method approved by the Company
6.6 Chargebacks A Client should first contact the Company to resolve any genuine payment or service dispute before initiating a payment reversal or chargeback, except where the Client is exercising a legal right to do so. The Company reserves the right to provide relevant Booking, payment and service records to a payment provider or financial institution in response to a disputed transaction.
7. What Is Included
Unless expressly stated otherwise in the Booking Confirmation or itinerary, Safari packages may include:
- accommodation specified in the itinerary
- meals specifically identified in the itinerary
- airport or other transfers specifically stated in the itinerary
- ground transportation during the Safari
- scheduled game drives
- conservation activities included in the itinerary
- guided experiences
- professional guides, rangers or trackers where applicable
- park entrance fees
- conservation levies
- concession fees included in the itinerary
- drinking water during scheduled transfers and game drives
The precise inclusions applicable to each Booking are those stated in the Client's Booking Confirmation and itinerary.
8. What Is Not Included
Unless expressly stated otherwise in writing, the following are excluded:
- international flights
- domestic flights
- visas and entry permits
- passports and travel documents
- vaccinations and medical expenses
- travel insurance
- cancellation or interruption insurance
- emergency medical evacuation
- repatriation
- personal expenses
- laundry
- telephone and internet charges
- minibar purchases
- premium or alcoholic beverages
- meals not specified as included
- optional activities
- gratuities
- excess baggage
- expenses resulting from delayed or cancelled flights
- additional accommodation required due to travel disruption
- personal purchases
- any other item not expressly stated as included
9. Cancellation & Refunds
All cancellations must be submitted to the Company in writing. Cancellation dates are calculated by reference to the scheduled Departure Date. The following Cancellation and Refund Policy applies, subject to any rights available to the Client under applicable law.
9.1 Cancellation Within 14 Days of Booking If you cancel within 14 days of the date your Booking is confirmed and more than 100 days before departure, you will receive a 100% refund of your deposit. This provision applies only where both conditions are met: 1. the cancellation is made within 14 days of Booking; and 2. the cancellation is made more than 100 days before departure.
9.2 Cancellation More Than 100 Days Before Departure Cancellations made more than 100 days before departure and outside the 14-day period described above are subject to the following:
- The deposit is non-refundable
- At the Company's discretion, up to 75% of the deposit may be transferred to another Legacy Conservation Safaris trip or retained as a credit for future travel
- Any transfer or credit is subject to availability, applicable booking terms and any difference in price between the original and future Safari
- The remaining portion of the deposit is not transferable or refundable. Any transfer or credit offered by the Company is subject to the terms communicated at the time it is granted. 9.3 Cancellation Between 100 and 60 Days Before Departure Full payment is due 100 days before departure. If you cancel between 100 and 60 days before departure:
- payments made are generally non-refundable and non-transferable
- no portion of the Booking is automatically transferable to another trip
- at its sole discretion, the Company may provide a refund of up to 25% of the total trip cost. Any refund offered under this section is discretionary and will be determined by the Company having regard to the circumstances of the cancellation, costs incurred or committed, and the Company's ability to resell the cancelled services. Any such refund remains subject to applicable law. 9.4 Cancellation Within 60 Days of Departure Cancellations made less than 60 days before departure are generally 100% non-refundable and non-transferable. No refund or transfer will ordinarily be provided. This provision remains subject to any mandatory rights available to the Client under applicable law. 9.5 Failure to Travel No refund is ordinarily available for:
- failure to arrive
- late arrival
- voluntary withdrawal during the Safari
- unused accommodation
- unused activities
- missed transfers
- early departure
- services voluntarily declined by the Client
10. Force Majeure & Events Outside Our Control
The Company shall not be responsible for delay, cancellation, alteration or inability to perform a Safari to the extent caused by circumstances beyond the Company's reasonable control. Such circumstances may include:
- natural disasters
- floods
- wildfires
- severe weather
- disease outbreaks or pandemics
- government restrictions
- border closures
- political unrest
- civil disturbance
- terrorism or security incidents
- strikes
- industrial disputes
- transport disruptions
- airline disruptions
- road closures
- reserve or park closures
- wildlife-related safety restrictions
- conservation emergencies
- other events which could not reasonably have been anticipated or prevented. Where such circumstances occur, the Company will take reasonable steps to minimise disruption and, where practical, may offer:
- an alternative itinerary
- alternative accommodation
- an alternative Safari date
- a travel credit
- another reasonable alternative
Any refund or credit will depend on the circumstances, amounts recoverable from Suppliers and other non-recoverable costs, subject always to applicable law.
12. Changes to Itineraries & Services
12.1 Safaris operate in dynamic natural environments and itineraries may need to change. The Company reserves the right to make reasonable changes to:
- routes
- schedules
- accommodation
- vehicles
- guides
- activities
- game-drive locations
- conservation activities
- other itinerary components. 12.2 Changes may be required because of:
- weather
- wildlife movement
- road conditions
- reserve conditions
- conservation requirements
- safety considerations
- operational requirements
- Supplier availability
- government or reserve restrictions
- circumstances beyond the Company's reasonable control
12.3 Where a material change is required, the Company will make reasonable efforts to provide an alternative of a comparable standard where practicable.
12.4 The Company does not guarantee that every advertised activity, accommodation property, route or wildlife experience will be available at all times.
13. Wildlife & Safari Conditions
13.1 Wildlife is wild, unpredictable and cannot be controlled. The Company does not guarantee sightings of any particular species, including the Big Five, or any particular wildlife behaviour or experience.
13.2 The absence of a particular wildlife sighting does not constitute a failure to provide the Safari.
13.3 Wildlife movement, animal behaviour, weather, vegetation, road conditions and conservation priorities may affect the duration, route and location of game drives.
13.4 The safety and welfare of guests, guides, local communities and wildlife take priority over obtaining a particular wildlife sighting or fulfilling a particular photographic opportunity.
13.5 Guests must comply with all wildlife-viewing instructions and reserve regulations.
14. Accommodation
14.1 Accommodation will generally be provided at the property specified in the Client's itinerary.
14.2 Where the specified accommodation becomes unavailable due to circumstances beyond the Company's reasonable control, the Company may provide comparable alternative accommodation where reasonably possible.
14.3 Accommodation facilities, room configurations, views, amenities and services may vary between properties.
14.4 Special requests, including particular room locations, bed configurations, adjoining rooms or specific views, are requests only unless expressly confirmed in writing.
14.5 If a Client requests single occupancy where the Booking is based on shared accommodation, an applicable single supplement may apply.
15. Flights, Transfers & Travel Delays
15.1 Unless expressly stated otherwise, flights are not included in the Safari price.
15.2 Clients are responsible for ensuring that their flight arrangements allow sufficient time to meet scheduled transfers and Safari departure times.
15.3 The Company is not responsible for airline delays, cancellations, missed connections, lost baggage or other airline disruptions, except where liability cannot lawfully be excluded.
15.4 Where a Client's flight is delayed or cancelled and an arranged transfer is missed, the Company will make reasonable efforts to assist with alternative arrangements, subject to availability.
15.5 Additional costs resulting from flight delays, cancellations, missed transfers or other travel disruption may be charged to the Client unless otherwise agreed or recoverable under the Client's travel insurance.
16. Client Travel Documents & Entry Requirements
Clients are responsible for ensuring they possess:
- a valid passport
- any required visa or entry permit
- required transit documentation
- required vaccinations or health documentation
- any other documents required by South Africa or a transit country
The Company may provide general travel information but does not guarantee that a Client will be granted entry into South Africa or any other country. Clients should obtain current advice from the relevant embassy, consulate, immigration authority or other official source.
17. Travel Insurance
Comprehensive travel insurance is strongly recommended and, where specified in the Booking Confirmation, may be a condition of participation. Clients are strongly advised to obtain insurance covering, where reasonably available:
- medical expenses
- emergency evacuation
- repatriation
- trip cancellation
- trip interruption
- travel delays
- baggage and personal belongings
- personal liability
The Company does not provide medical or evacuation insurance and is not responsible for expenses that should reasonably be covered by the Client's insurance. The Company may request evidence of adequate travel insurance where appropriate.
18. Health, Medical, Dietary & Special Requirements
18.1 Safari activities may take place in remote areas where access to medical facilities and emergency services may be limited. Clients are responsible for ensuring that they are medically and physically able to participate in the Safari and its activities.
18.2 Clients must inform the Company as early as reasonably possible, and preferably at the time of Booking, of any medical, mobility, dietary, allergy or other special requirements that may reasonably affect their participation in the Safari or the Company's ability to safely provide the services.
18.3 The Company will make reasonable efforts to accommodate notified requirements and, where appropriate, communicate them to relevant accommodation providers, activity providers and other Suppliers. However, due to the remote nature of certain Safari destinations and reliance on third-party Suppliers, specific dietary products, brands, facilities or other special arrangements cannot always be guaranteed.
18.4 Clients with serious allergies, medical conditions, dietary requirements or other special needs remain responsible for taking appropriate precautions and, where requested, communicating their requirements directly to relevant accommodation or activity providers.
18.5 Clients are responsible for bringing sufficient supplies of any prescription medication, medical equipment or other essential personal items they require during the Safari.
18.6 The Company may reasonably restrict, modify or decline a Client's participation in a particular activity where it reasonably believes that participation presents a safety risk to the Client, other guests, staff, Suppliers or wildlife.
18.7 In an emergency, the Company may arrange medical assistance, evacuation or other emergency services where reasonably necessary. Any resulting costs remain the Client's responsibility, unless otherwise covered by the Client's insurance or where liability rests with the Company under applicable law.
18.8 Clients are strongly advised to obtain comprehensive travel insurance that includes medical expenses and emergency evacuation, particularly where the Safari takes place in remote areas.
20. Safety & Client Conduct
Clients must:
- follow reasonable and lawful instructions from guides and staff
- comply with reserve, park and accommodation rules
- remain within designated areas
- maintain appropriate behaviour around wildlife
- respect other guests and local communities
- use vehicles and accommodation facilities responsibly
- refrain from behaviour that creates a safety risk
- comply with applicable South African laws. The Company may refuse participation in an activity or, where reasonably necessary, require a Client to leave the Safari where the Client:
- behaves abusively or threateningly
- behaves illegally
- is intoxicated to an extent that creates a safety risk
- repeatedly disregards safety instructions
- endangers themselves or others
- interferes with wildlife
- damages property
- materially disrupts the experience of other guests
Where a Client is required to leave because of their conduct, no refund will ordinarily be payable for unused services, subject to applicable law. The Client may also be responsible for reasonable costs arising from damage intentionally or negligently caused by them.
21. Children & Minors
Children and minors may only participate in Safaris where the relevant itinerary, accommodation provider and activity providers permit participation. Parents or legal guardians are responsible for:
- supervising minors in their care
- ensuring that minors follow safety instructions
- providing appropriate travel documentation
- ensuring that minors comply with these Terms & Conditions
Certain activities may have minimum age requirements imposed by reserves, lodges, activity providers or safety regulations.
22. Environmental & Conservation Responsibility
Legacy Conservation Safaris is committed to responsible tourism and conservation. Clients agree to:
- respect wildlife
- maintain appropriate viewing distances
- never feed or provoke wildlife
- never interfere with animals or their habitats
- avoid littering
- minimise environmental impact
- comply with reserve and conservation regulations
- respect local communities and cultural sites
- refrain from removing natural, archaeological, historical or cultural objects
Conservation activities may be modified, postponed or cancelled where required for animal welfare, conservation priorities, operational reasons or safety.
23. Conservation Activities & Specialist Experiences
Some Safaris may include conservation, research or wildlife-management activities that are not ordinary tourist activities. Participation may be subject to:
- age restrictions
- physical requirements
- safety briefings
- reserve regulations
- veterinary or conservation protocols
- weather and operational conditions
- permissions from relevant authorities
- the availability of suitably qualified personnel
The Company may modify or cancel such activities where necessary for safety, animal welfare, conservation or operational reasons.
24. Third-party Suppliers
24.1 The Company may arrange services provided by independent third parties, including:
- accommodation providers
- airlines
- transport operators
- reserves and parks
- restaurants
- activity providers
- guides
- conservation organisations
- other service providers
24.2 The Company takes reasonable care in selecting and coordinating third-party Suppliers.
24.3 Third-party Suppliers remain responsible for the services they independently provide.
24.4 The Company will not be liable for a third party's acts, omissions, insolvency, negligence, delay or failure to perform to the extent that such liability may lawfully be excluded. Nothing in this clause excludes or limits any liability that the Company is not legally permitted to exclude or limit.
25. Liability & Assumption of Risk
Safari travel involves inherent and sometimes unpredictable risks, including but not limited to:
- wildlife encounters
- walking in natural environments
- uneven terrain
- vehicle travel
- remote locations
- weather conditions
- insects and animals
- water-related activities where applicable
- illness
- road accidents
- activities conducted by third parties
- limited access to medical facilities
Clients acknowledge these inherent risks and agree to comply with reasonable safety instructions. Before participating in the Safari, Clients may be required to sign a separate Liability Waiver, Assumption of Risks & Release. Nothing in these Terms & Conditions or the Liability Waiver excludes liability where such exclusion is prohibited by applicable law.
26. Personal Belongings
Clients are responsible for their personal belongings, passports, money, electronics, luggage and other possessions. The Company recommends that valuables be kept secure and that Clients maintain appropriate travel insurance. The Company is not responsible for loss, theft or damage to personal property except to the extent that liability cannot lawfully be excluded.
27. Photography, Video & Media
The Company, its guides and authorised representatives may take photographs or video footage during Safaris for operational, documentary, educational or conservation purposes. Any use of identifiable Client images for commercial advertising, promotional campaigns or social media marketing will be subject to the Company's applicable consent process and any rights available to the Client under applicable law. Clients may request that the Company not use identifiable images of them for promotional purposes. Clients may themselves take photographs and videos during the Safari provided that doing so does not compromise safety, disturb wildlife, interfere with guides or infringe the privacy of other guests.
28. Privacy & Personal Information
The Company collects and processes personal information necessary to administer and deliver the Client's Safari. This may include:
- names
- contact information
- passport and travel information
- flight information
- emergency contact information
- dietary information
- relevant medical or accessibility information
- insurance information
- payment-related information
Personal information may be shared with accommodation providers, transport providers, reserves, activity providers, insurers, emergency service providers, government authorities and other service providers where reasonably necessary to provide the Safari or where required by law. The Company will process personal information in accordance with applicable South African data-protection legislation, including the Protection of Personal Information Act, 2013 ("POPIA"). The Company does not ordinarily store complete payment-card details.
29. Intellectual Property
All content belonging to Legacy Conservation Safaris, including its:
- name
- logo
- branding
- website content
- itineraries
- written materials
- photographs
- videos
- graphics
- other original materials is owned by or licensed to the Company and may not be reproduced, copied, distributed or commercially used without prior written permission, except where permitted by law
30. Complaints
30.1 If a Client experiences a problem during the Safari, the Client should notify the Company or an appropriate representative as soon as reasonably possible so that the Company has a reasonable opportunity to investigate and, where possible, resolve the issue during the Safari.
30.2 Where a problem cannot be resolved during the Safari, the Client should submit a written complaint to: info@legacysafaris.org within 30 days after completion of the Safari where reasonably possible.
30.3 The 30-day period is intended to facilitate prompt investigation and resolution and does not exclude or limit any mandatory legal rights available to the Client.
30.4 Clients may also have the right to refer tourism-related complaints to the relevant South African authorities or applicable consumer-protection bodies.
31. Changes to These Terms
The Company may update these Terms & Conditions from time to time. The version applicable to a Client's Booking will generally be the version in effect when the Booking is confirmed, unless a later amendment is required by applicable law or agreed with the Client. Changes will not retrospectively remove rights already accrued by a Client.
32. Notices & Communications
Unless otherwise agreed, formal notices relating to a Booking, including cancellations, should be provided in writing by email to: info@legacysafaris.org The Company may communicate with Clients using the email address or other contact details supplied during the Booking process. Clients are responsible for ensuring that the Company has accurate contact information.
33. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue to apply to the extent permitted by law.
34. No Waiver
A failure or delay by the Company to enforce any provision of these Terms & Conditions does not constitute a waiver of that provision or of the Company's right to enforce it in the future.
35. Entire Agreement & Order of Precedence
The Client's Booking consists of: 1. the Booking Confirmation and any specific written terms expressly agreed with the Client; 2. these Terms & Conditions; 3. the applicable Cancellation Policy; and 4. the Liability Waiver, Assumption of Risks & Release. Where there is a conflict between a specific written term contained in the Booking Confirmation and these general Terms & Conditions, the specific written term will apply to the extent of the conflict. Nothing in this clause limits any mandatory rights available to the Client under applicable law.
36. Governing Law & Disputes
These Terms & Conditions are governed by the laws of the Republic of South Africa. The parties will first attempt in good faith to resolve any dispute through direct communication. Where a dispute cannot be resolved directly, either party may pursue any remedy or dispute-resolution process available under applicable law. Subject to any mandatory consumer rights, statutory dispute-resolution mechanisms or jurisdictional requirements, the courts of the Republic of South Africa will have jurisdiction over disputes arising from or relating to these Terms & Conditions or the Safari.
37. Acceptance
By paying the required deposit, making a payment toward the Safari, signing a Booking Confirmation, or otherwise confirming participation, the Client acknowledges that they have had the opportunity to read and understand:
- these Terms & Conditions
- the applicable Cancellation Policy
- the Liability Waiver, Assumption of Risks & Release
- any other booking-specific terms provided by the Company
The Client agrees to comply with these documents as applicable to their Booking.
